Terms of Service

Last updated 6 November 2026

These Terms of Service govern your access to and use of CapiMail. By creating a workspace or sending email through CapiMail, you agree to these terms, our Acceptable Use Policy, and our Anti-Spam Policy.

Your account

  • You are responsible for activity under your workspace and for keeping credentials and API keys secure.
  • Live sending requires a verified sending domain and organization approval; registration alone does not authorize sending. We may decline, pause, or revoke access.
  • You must provide accurate organization information and keep it current.

Reviewed marketing access

Marketing sending requires separate review of your account, domain, sender identity, recipient consent, content, and requested volume. Approved workspaces receive bounded, time-limited access. Joining the waitlist, buying credits, or account age does not grant access or automatically raise limits. Access remains subject to delivery health, ongoing review, and platform sending controls.

Acceptable use and sending

Your use of CapiMail must comply with our Acceptable Use and Anti-Spam Policies and with applicable law, including email and data-protection regulations in the jurisdictions you send to. You are responsible for obtaining and maintaining consent for the recipients you contact.

WhatsApp messaging

When WhatsApp messaging is enabled for your workspace, you connect a WhatsApp Business Account that you own through Meta's signup flow, and you remain the owner of that account and its phone numbers. You must comply with the WhatsApp Business Terms of Service, the WhatsApp Business Messaging Policy, and the WhatsApp Commerce Policy, obtain opt-in from each recipient before messaging them, and use only templates approved by Meta for business-initiated messages. Meta may review, restrict, or disable your account or templates independently of CapiMail. We may pause WhatsApp sending from your workspace to enforce these policies.

Credits and billing

  • Each recipient accepted by the email provider uses one prepaid credit for an email up to 1 MB, plus one credit for every started additional 1 MB. Size is the subject, HTML and text bodies, and attachments after decoding. Credits are reserved when a live request is queued and charged on provider acceptance, which does not guarantee delivery or inbox placement.
  • A definitively failed or cancelled send before provider acceptance releases its reservation. If the provider outcome is unknown, credits remain reserved pending reconciliation. A later bounce or complaint does not reverse a provider-accepted charge.
  • Credit purchases and balances are recorded in an auditable ledger. Purchased credits do not expire and there is no monthly subscription. Prices and packages may change prospectively.
  • Credits are added only after the payment provider confirms a payment. If a top-up payment is refunded, the credits it granted are removed from your available balance. Any manual correction to a balance is recorded in the ledger with its reason.
  • Your first 300 emails are free: a one-time allowance per eligible, verified organization domain, subject to review and approval. No credit card is required. Credits do not override sending limits or access requirements.

Service availability and changes

We work to keep CapiMail reliable and provide the service on an “as available” basis. We may change, suspend, or discontinue features, and we may pause sending to protect platform deliverability and other customers.

Suspension and termination

We may suspend or terminate access for violations of these terms or our policies, for non-payment, or to protect the platform. You may stop using CapiMail at any time; certain records are retained as described in our Privacy Policy and for legal and audit purposes.

Liability

To the extent permitted by law, CapiMail is not liable for indirect or consequential damages, and our aggregate liability for any claim is limited to the amount you paid for the service in the three months before the event giving rise to the claim. Nothing here excludes liability that cannot be excluded by law.
